To qualify as a trade secret, the confidential information must be commercially valuable because it is secret, known only to a limited group of persons, and subject to reasonable steps taken by the rightful holder to keep it secret  (such as using confidentiality agreements with business partners and employees). Trade secrets can include a wide range of confidential business information that provides a competitive edge, such as technical information (e.g., manufacturing processes, pharmaceutical test data, recipes, formulas, computer programs) and commercial information (e.g., distribution methods, lists of suppliers). The unauthorized acquisition, use, or disclosure of trade secrets in a manner contrary to honest commercial practices is considered an unfair practice and a violation of trade secret protection.
