Geographical indications

{definition}: “A sign used on products that have a specific geographical origin and possess qualities or a reputation that are due to that origin.”

The geographical indications service

Our trademark attorneys assist companies and associations to protect products through geographical indications. These geographical indications allow customers to identify a product as originating in a given place or with qualities and characteristics due to the place of origin.  The products concerned are agricultural products (e.g. Herve cheese), wines (e.g. Champagne), spirits (e.g. Cognac), as well as artisanal and industrial products.

There are several ways to protect a geographical indication. First of all, there are several sui generis protection systems (protected designations of origin, protected geographical indications, and traditional specialties guaranteed). Most of the geographical indications protected by these systems are listed on the European Commission's eAmbrosia website or on the EUIPO's GIview website. Protection can also be provided through collective or certification marks, unfair commercial practices and administrative product approval systems.

Why and to whom is it useful?

Geographical indications are useful to a wide range of individuals, businesses, and organizations that produce or market goods linked to a specific region. For agricultural producers it protects regional agricultural products. For craftsmen it encourages cultural preservation and ensures that only products made in a designated region can use the geographical indication. For food manufacturers it ensures product authenticity and quality control. For governments it promotes local industries and encourages exports and tourism. In short, geographical indications benefit producers, businesses, governments and consumers by protecting unique regional products and supporting economic and cultural development.
